2.2 Service Availability

  • We aim for 99.9% uptime but cannot guarantee uninterrupted service

  • Scheduled maintenance will be announced in advance when possible

  • Emergency maintenance may occur without prior notice

2.3 What Tripzy Does NOT Provide

  • Legal advice regarding hosting regulations

  • Property management services

  • Guest verification or background checks

  • Insurance coverage for property damage

  • Resolution of disputes between hosts and guests

3. User Accounts and Eligibility

3.1 Account Creation

  • You must be at least 18 years old to use our Service

  • You must provide accurate, current information during registration

  • You're responsible for maintaining the security of your account credentials

  • You may not create multiple accounts or share accounts with others

3.2 Account Verification

  • We may require verification of your identity and property ownership

  • False information may result in immediate account termination

  • We reserve the right to refuse service to any individual or entity

3.3 Host Responsibilities

You agree to:

  • Provide accurate property information, house rules, and local recommendations

  • Keep your property details updated and current

  • Comply with all applicable laws and regulations regarding vacation rentals

  • Monitor emergency escalations and respond promptly to urgent guest issues

  • Not use the Service for any illegal or unauthorized purpose

4. Payment Terms

4.1 Pricing Structure

  • Standard Plan: $29 per property per month

  • Enterprise Plans: Custom pricing for 10+ properties

4.2 Payment Processing

  • All payments processed securely through Stripe

  • You authorize automatic billing for recurring subscriptions

  • Prices are subject to change with 30 days advance notice

  • All fees are non-refundable except as explicitly stated

4.3 Free Trial

  • New users receive a 7-day free trial

  • No credit card required for trial activation

  • Trial automatically converts to paid subscription unless cancelled

  • Only one free trial per user/property

4.4 Late Payment and Suspension

  • Accounts may be suspended for non-payment after 7 days

  • Service restoration requires payment of all outstanding balances

  • We may terminate accounts with payment delinquency exceeding 30 days

4.5 Refunds

  • 30-day money-back guarantee for new subscribers

  • No refunds for partial months or usage-based services

5. Proper Use of the Service

5.1 Acceptable Use

You may use our Service only for:

  • Legitimate vacation rental guest communication

  • Properties you own, manage, or are authorized to represent

  • Lawful purposes in compliance with all applicable regulations

5.2 Prohibited Activities

You may not:

  • Use the Service for non-vacation rental properties without authorization

  • Upload false, misleading, or harmful property information

  • Attempt to reverse engineer, hack, or compromise our systems

  • Share your account credentials with unauthorized parties

  • Use the Service to violate any laws, regulations, or third-party rights

  • Engage in spam, harassment, or abusive behavior toward guests or staff

  • Interfere with other users' access to or use of the Service

5.3 Content Standards

All content you provide (property descriptions, house rules, recommendations) must be:

  • Accurate and truthful

  • Non-discriminatory and compliant with fair housing laws

  • Free from offensive, inappropriate, or illegal content

  • Respectful of guest privacy and safety

6. Intellectual Property Rights

6.1 Tripzy's Rights

  • Tripzy owns all rights to the Service, including software, platform integrations, and branding

  • Our service methodology and property-specific AI training processes are proprietary

  • You may not copy, modify, or create derivative works of our Service

  • All trademarks, logos, and branding remain Tripzy's exclusive property

6.2 Your Content

  • You retain ownership of property descriptions and recommendations you provide

  • You grant Tripzy a license to use your content for providing the Service

  • You represent that you have all rights necessary to provide such content

  • Tripzy may remove content that violates these Terms or applicable law

6.3 AI-Generated Responses

  • Responses generated by our AI are considered Tripzy's intellectual property

  • You may use AI responses for their intended purpose (guest communication)

  • You may not extract, republish, or commercialize AI responses outside the Service

7. Third-Party Integrations

7.1 Booking Platform Integrations

  • Integrations with Airbnb, VRBO, Booking.com are subject to their respective terms

  • We are not responsible for changes to third-party APIs or policies

  • Integration failures due to third-party changes do not constitute breach of these Terms

7.2 Google API Services

  • Subject to Google's Terms of Service and usage policies

  • Google data accuracy and availability are not guaranteed by Tripzy

7.3 Payment Processing

  • Payment processing provided by Stripe, Inc.

  • Tripzy is not responsible for payment processing failures or disputes

8. AI Service Limitations and Disclaimers

8.1 AI Response Accuracy

  • Our AI provides responses using OpenAI's technology combined with your property information

  • We strive for accuracy but cannot guarantee 100% correct responses from AI systems

  • You remain responsible for monitoring and correcting AI responses as needed

  • Emergency situations are escalated to you for human intervention

8.2 Service Limitations

  • AI responses depend on OpenAI's API availability and performance

  • Service interruptions may occur due to OpenAI maintenance or outages

  • AI may not understand complex, unusual, or highly specific guest requests

  • Local recommendations depend on Google API data availability and accuracy

  • Response quality depends on the accuracy of property information you provide

  • Service performance may vary based on internet connectivity and system load

8.3 No Warranties

The Service is provided "as is" without warranties of any kind, including:

  • Accuracy or reliability of AI responses

  • Uninterrupted or error-free operation

  • Compatibility with all devices or platforms

  • Achievement of specific guest satisfaction or review scores

9. Limitation of Liability

9.1 Limited Liability

To the maximum extent permitted by law, Tripzy's total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9.2 Excluded Damages

Tripzy shall not be liable for:

  • Indirect, incidental, punitive, or consequential damages

  • Lost profits, revenue, or business opportunities

  • Property damage or personal injury to guests

  • Disputes between hosts and guests

  • Negative reviews or reduced booking rates

  • Third-party platform policy violations or account suspensions

9.3 Guest-Related Issues

You acknowledge that:

  • Guest behavior and satisfaction are beyond our control

  • We cannot prevent negative reviews or guest complaints

  • Property damage, theft, or safety issues are host responsibilities

  • Legal disputes with guests must be resolved independently

10. Indemnification

You agree to indemnify, defend, and hold harmless Tripzy and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from:

  • Your use of the Service or violation of these Terms

  • Your property operations or guest interactions

  • Inaccurate or misleading information you provide

  • Violation of any laws, regulations, or third-party rights

  • Disputes with guests or booking platforms

  • Claims of discrimination or fair housing violations

11. Data Protection and Privacy

11.1 Guest Communications

  • All guest messages are processed to provide AI responses

  • Guest conversations are automatically deleted after 90 days

  • You may request longer retention periods for business purposes

  • Emergency messages may be retained longer for safety reasons

11.2 Data Security

  • We implement industry-standard security measures

  • Data breaches will be reported as required by applicable law

  • You're responsible for protecting your account credentials

12. Account Termination

12.1 Termination by You

  • You may cancel your account at any time through your dashboard

  • Cancellation takes effect at the end of your current billing period

  • No refunds for partial months except as stated in Section 4.5

We may suspend or terminate your account for:
